Welcome to Heyooh. These Terms and Conditions ("Terms") govern your access to and use of the Heyooh mobile application and related services (collectively, the "Service"). The Service is operated by Heyooh Limited ("Heyooh," "we," "our," or "us"), a company registered in Hong Kong, with its registered office at Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Heyooh. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you.
For the purpose of these Terms:
- **"Heyooh"** refers to Heyooh Limited, the owner and operator of the Heyooh mobile application and related services.
- **"Service"** means the Heyooh mobile application and all related services, features, content, and functionality.
- **"User"** means any individual who accesses or uses the Service, including you.
- **"Account"** means a registered account that enables you to access and use the Service.
- **"Content"** means any information, text, graphics, photos, videos, or other materials uploaded, downloaded, or appearing on the Service.
- **"User Content"** means Content that Users post, upload, publish, submit, or transmit to be made available through the Service.
- **"Tennis Facility"** means any tennis court, club, or venue that is accessible through the Service.
The ownership of the Heyooh mobile application and related services is held by Heyooh Limited, registered in Hong Kong, with its registered office at Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong.
This document regulates the conditions governing the use of our Service and the purchase or acquisition of services on it.
For the purposes of these Terms, it is understood that the activity that Heyooh develops through the Service includes:
- Connecting tennis players and enthusiasts
- Facilitating tennis match arrangements
- Providing tennis community features
- Offering premium features for subscribers
In addition to reading these Terms, before accessing, browsing, and/or using our Service, you must have read the Cookie Policy and Privacy Policy. By using our Service or making and/or requesting the acquisition of a product and/or service through it, you agree to be bound by these Terms and all of the above. If you do not agree with all of the above, you must not use our Service.
Heyooh may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.
To use the Service, you must be at least 18 years old and capable of forming a binding contract. By using the Service, you represent and warrant that you meet these requirements and that:
- You are of legal age to form a binding contract with Heyooh
- You are not a person barred from receiving services under the laws of Hong Kong or other applicable jurisdiction
- You will only use the Service for lawful purposes and in accordance with these Terms
- You will provide accurate, current, and complete information during the registration process and maintain and promptly update this information
- You are responsible for safeguarding your account credentials and for any activities or actions under your account
To access certain features of the Service, you must register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. Specifically, we collect:
- First name
- Last name
- Email address
- Phone number
- Gender
- Age range (not specific age)
- Profile picture (optional)
- Self-introduction information (optional)
- Tennis skill level
- Language preferences
- Best hand (right/left/both)
- Years of playing tennis
- Preferred game locations
- Other sports interests
You are responsible for safeguarding your Account password and for any activities or actions under your Account. You agree to:
- Create a strong password that you do not use with other online services
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your Account or any other breach of security
- Ensure that you log out from your Account at the end of each session when accessing the Service on a shared device
We reserve the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms.
You may not:
- Create more than one Account
- Create an Account for someone other than yourself
- Transfer your Account to another person
- Use a username that is offensive, vulgar, or infringes on someone else's rights
- Provide false or misleading information when registering an Account
- Use the Service if you have previously been banned or removed
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Harass, abuse, or harm another person
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Collect or store personal data about other Users without their consent
- Restrict or inhibit any other User from using the Service
- Use the Service for any commercial purpose without our prior written consent
- Attempt to access areas of the Service that you are not authorized to access
- Use any robot, spider, or other automatic device, process, or means to access the Service
- Introduce any viruses, Trojan horses, worms, logic bombs, or other harmful material
- Engage in any activity that could disable, overburden, damage, or impair the Service
As a tennis-focused social platform, we expect Users to:
- Honor scheduled matches and arrive on time
- Respect court rules and etiquette
- Accurately represent their tennis skill level
- Treat other players with respect and sportsmanship
- Report match results honestly
- Maintain proper conduct on and off the court
- Respect the facilities and equipment
- Follow the rules of the tennis facilities
If you fail to appear for a scheduled match without providing at least 4 hours' notice, you may be subject to penalties including:
- Warning notifications
- Temporary restrictions on booking capabilities
- Account suspension for repeated violations
You are strictly prohibited from:
- Manipulating match results or rankings
- Creating fake accounts or profiles
- Engaging in any form of harassment or bullying
- Posting inappropriate or offensive content
- Soliciting other users for purposes unrelated to tennis
- Using the Service for any illegal activities
- Attempting to defraud other users or Heyooh
- Engaging in any activity that damages the reputation of Heyooh or its users
You are solely responsible for your User Content and the consequences of posting or publishing it. By posting User Content, you represent and warrant that:
- You own or have the necessary rights to use and authorize us to use your User Content
- Your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights
- Your User Content complies with these Terms and all applicable laws and regulations
- Your User Content is not defamatory, obscene, offensive, or otherwise objectionable
- Your User Content does not contain any viruses, adware, spyware, worms, or other malicious code
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations, including for promoting and redistributing part or all of the Service.
You also grant each User a non-exclusive license to access your User Content through the Service and to use, reproduce, distribute, and display such User Content as permitted through the functionality of the Service and under these Terms.
We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice. We also reserve the right to terminate a User's access to all or part of the Service for posting prohibited content.
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Heyooh and its licensors. The Service is protected by copyright, trademark, and other laws of Hong Kong and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Heyooh.
Subject to your compliance with these Terms, Heyooh grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:
- Access and use the Applications on your personal device solely in connection with your use of the Services
- Access and use any content, information, and related materials that may be made available through the Services
Any rights not expressly granted herein are reserved by Heyooh and Heyooh's licensors.
You may not:
- Remove any copyright, trademark, or other proprietary notices from any portion of the Service
- Reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Service except as expressly permitted by Heyooh
- Decompile, reverse engineer, or disassemble the Service except as may be permitted by applicable law
- Link to, mirror, or frame any portion of the Service
- Cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Service
- Attempt to gain unauthorized access to or impair any aspect of the Service or its related systems or networks
The Service may contain links to third-party websites or services that are not owned or controlled by Heyooh. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Heyooh shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
The Service may integrate with third-party services, such as payment processors, social media platforms, or tennis club booking systems. Your use of such third-party services is subject to their terms and conditions and privacy policies.
We may offer paid services or features within the Service. All fees are in Hong Kong Dollars (HKD) unless otherwise stated and are exclusive of applicable taxes.
You agree to pay all fees and applicable taxes incurred by you or anyone using your Account. We may change the fees for any feature of the Service, including additional fees or charges, if we give you advance notice of changes before they apply.
Some aspects of the Service may be available on a subscription basis. By subscribing, you agree to the following:
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Payment will be charged to your payment method at confirmation of purchase
- You authorize us to charge your payment method for the subscription fee at the then-current rate
- Subscriptions may be managed and auto-renewal may be turned off in your account settings
All purchases are final and non-refundable, except as required by applicable law or at our sole discretion. If you believe that Heyooh has charged you in error, you must contact us within 90 days of such charge.
Payment processing services for Users are provided by our third-party payment processors (e.g., Stripe, PayPal) and are subject to their terms of service and privacy policy. You agree to abide by those terms when using their services.
When you book a tennis court through our Service:
- You agree to comply with the rules and policies of the tennis facility
- You are responsible for arriving on time and using the court only during your booked time slot
- You must pay any applicable fees for the booking
- Cancellation policies are set by the individual tennis facilities and may vary
While we strive to provide accurate information about tennis facilities, including availability, pricing, and amenities, we cannot guarantee the accuracy of this information. Tennis facilities are responsible for providing and updating their information.
Heyooh is not responsible for the actions or omissions of any tennis facility. Your use of a tennis facility is subject to the facility's own terms and conditions. Any disputes regarding the condition, quality, or services of a tennis facility should be directed to the facility management.
You may terminate your Account at any time by following the instructions in the Service or by contacting us at service@heyooh.co.
We may terminate or suspend your Account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If your Account is terminated for any reason, you must obtain written authorization from Heyooh before establishing a new Account.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Heyooh does not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location
- Any errors or defects will be corrected
- The Service is free of viruses or other harmful components
- The results of using the Service will meet your requirements
Heyooh does not guarantee:
- The skill level, behavior, or reliability of other Users
- The availability or condition of tennis courts or facilities
- The outcome or quality of tennis matches arranged through the Service
- The accuracy of tennis statistics or ratings
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEYOOH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
- ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Heyooh and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that your User Content caused damage to a third party
This defense and indemnification obligation will survive these Terms and your use of the Service.
We process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to such processing and you represent that all information you provide is accurate.

We are committed to complying with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO"). You have rights regarding your personal data as outlined in our Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at service@heyooh.co.
If a dispute cannot be resolved informally, you and Heyooh agree to submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
You agree that any claim or cause of action arising out of or related to these Terms or the use of the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
These Terms constitute the entire agreement between you and Heyooh regarding the Service and supersede all prior and contemporaneous written or oral agreements between you and Heyooh.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.
Heyooh shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.
Heyooh may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease. Users may terminate their accounts at any time by contacting Heyooh customer service at service@heyooh.co.
These Terms are written in English. Any translated version is provided solely for the convenience of users. In the event of any conflict between the English version and a translated version, the English version shall prevail.
